The Failure of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the diplomatic emergency caused by the presentation of a new 28-article proposal for resolving the conflict appeared – momentarily – to have been stabilised. A Washington representative spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Moscow made its retaliation: a renewed assault of missile and drone strikes on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of conflicting incidents captured the harsh reality of the recent timeframe. By day, negotiation efforts are waged: positive announcements are delivered from multiple capitals. Significant resources is allocated on managing particular approaches. By night, the Kremlin forcefully demonstrates the world that, for them, war remains the main instrument for achieving "peace".

Nighttime Reality

As military strikes unfolded into the early hours of Tuesday, the current condition of Ukraine's vulnerability was laid bare. Ukraine is equipped to monitor projectile deployments from across the border, a capability provided through timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to engage hostile guided weapons roared overhead – sophisticated military planes delivered to Ukraine by Western partners.

Moments later, Kyiv's anti-aircraft weapons engaged: several firings fired to intercept a Russian ballistic missile. This was a sophisticated defense system at work, probably delivered by Western nations. Every launch creates sudden vibrations, causing tremors. The moment of terror quickly becomes sober acceptance: perhaps the approaching threat won't hit its mark this time, protecting urban areas from devastation and further power outages.

Persistent Threats

Soon after, a automatic firearm opened up on a aerial vehicle close by, part of a rapid response unit – probably imported technology. Sadly, the bullets missed the enemy aircraft – it continued its flight toward its destination.

Periodically, this carried on until dawn. Kyiv faced the morning news: several casualties, damage and utility failures in numerous residences as a result of the nocturnal offensive. As always, everyone still went about their day – living the war. But those 24 hours demonstrated Ukraine's essential dependence on international aid – a dependence that neighboring countries are clearly incapable to fill in the short term.

Ineffective Peace Efforts

The detailed framework from US administration provoked deep reactions, debate and profound anxiety – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and multilateral gatherings.

Every new proposal from US leadership follows the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, effectively counters. They stabilise the situation but never actually win the battle. This trend will, certainly, persist.

Political Considerations

It is convenient to criticize certain parties of consistently pushing Russian terms. But that does not seem to be the complete picture. American leadership operates on a principle familiar among experienced diplomats: you cannot secure via talks what you have been unable to protect through force. The American government believes that it is unfeasible to pressure the Kremlin to relinquish the territory that it presently holds in Ukraine's southern or eastern regions.

The issue is that while acknowledging this situation, American administration does nothing to discourage Russia, through statements or actions, from thinking that the situation will not shift further in its benefit in the coming year.

Opposing Positions

Therefore, Russian leadership is confident that duration works to their advantage – that Ukraine and its partners are nearing depletion. Their reason to sign a deal that does not give them the greatest potential benefit is close to zero. There may be multiple initiatives to end hostilities, but they will carry on as long as Russia's leadership remains supremely confident in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still endure, progressively conceding civilians and areas but preventing a entire defensive failure until conditions improve in its favour.

Existing Situation

Realistically, there are no actual prerequisites for a truce. Now, individual motivations are coming into play: leadership ambitions to negotiate peace and achieve global acclaim, and Ukrainian leadership's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the country's interests against any initiative Kyiv finds unacceptable, so that their attention does not shift toward internal issues. And although their mission will now be significantly challenging after recent developments, it remains highly unlikely that this will alter their fundamental strategy.

These conflicting dynamics are driving the talks.

Summary and Prospects

It took a only one week to eliminate the proposed articles of the most recent proposal. Aggressive and erratic handling of the matter by Washington, resistance by Ukraine and the other European countries, along with calming attempts of negotiators, and finally, latest revelations, all achieved their purpose.

While new initiatives based on previous concepts are approaching, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are rooted in Kremlin requirements and show particular unwillingness to modify developments, if they remain united and enhance their military capacity at a considerably quicker tempo. If they do, neither external pressure nor military threats will be able to overcome them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the predictable period, mainly require continued Western support.
